Terms and Conditions

How we work, what is included in each service, what corresponds to each party and in what legal framework we operate.


These terms regulate the relationship between KLIPTOWN PUBLICITY AND DIDENO S.A. DE C.V. (hereinafter "the Society") and any natural or moral person who requests or contracts our digital audiovisual production services. The use of our website, any other digital channel enabled for contact or the sending of the contact form implies acceptance of what is described here, in accordance with articles 1792 and 1803 of the Federal Civil Code.

01 We provide services exclusively digital and remote.

We develop creative concepts, advertising scripts, storyboards, creative direction, campaign planning, video editing, animation, motion graphics, explanatory videos, reels, color correction, intra, outers and production with stock material. All deliverables are digital files. We do not make physical deliveries or manage physical media distribution or contracting of means or guidelines on behalf of the client.

02 The process begins with the choice of a plan in the online store.

By selecting a plan and completing the purchase process on our website, you contract the service in terms, features, delivery times and prices that are shown broken down on the corresponding page. No advances or partial charges are generated: payment is made for the total amount indicated at the time of purchase. The contractual link is born at the time the system confirms your payment and sends the order confirmation to the provided email. Any cancellation, change or refund will be governed exclusively by our current Reimbursement Policy, available on the website.

03 Prices + VAT are expressed in Mexican pesos.

The prices of each plan and service are shown in a breakdown directly on our website, indicating, where appropriate, the amount before taxes and the total amount with VAT included. VAT on these prices shall be applied at the rate of 16% in force, in accordance with the Value Added Tax Act. The company will issue the corresponding CIDF after the payment has been credited, for which the customer must provide his tax data at the time of confirming the service.

04 Payment is made online by a payment service provider.

The payment of the services is made exclusively in Mexican pesos, by credit or debit cards accepted by our online payment service provider. It is this supplier who processes and saves the card data, so the Society does not store or have access to the full information of the customer's means of payment. Once the payment is confirmed by the supplier, the order is released and the contract work is started.

05 The revisions included in each plan have a defined scope.

A review round is the customer's consolidated feedback on a given version. Additional comments sent out of that round, or changes that substantially modify the concept, script or originally agreed visual style, are quoted and billed separately. The Society does not take responsibility for delays when its cause is the customer's delay in delivering materials, approving versions or providing feedback.

06 The materials the customer gives us are his responsibility.

Videos, images, logos, music, texts and any other file that the customer provides for production must have the rights necessary for their commercial use. In sending them to us, the client states that he has these authorizations and responds for any claims arising from his use. The company shall use them exclusively for the project contracted and shall not share them with third parties except suppliers or collaborators involved in production, who shall be subject to equivalent confidentiality duties.

07 The final deliverables are from the customer. The tools are from the Society.

Once the total payment is covered, the Company gives the customer a commercial, non-exclusive and global license on the final files produced for its project, as specified in the specific proposal or contract. This transfer does not include editing or animation projects in their native format, templates, stock resources or specific methodologies of the Society, unless expressly agreed. The clips, music and typographs of third parties used are subject to the licences of their holders.

08 We can show your work as a reference, unless you indicate otherwise.

The projects made can appear in the Society's portfolio, website and commercial presentation materials. If the customer needs confidentiality about his project, he / she must indicate it in writing at the time of hiring and, where appropriate, sign the relevant confidentiality agreement (NDA).

09 The responsibility of the Society has a specific limit.

The Society does not guarantee specific results in sales, scope, interaction or performance on third-party platforms. The company does not respond for indirect damage, loss of profits, loss of contracts or campaign results on third party platforms. Under any circumstances, the maximum liability of the Society is limited to the amount actually paid for the service that caused the claim.

010 These terms are governed by Mexican laws and any controversy is resolved in CDMX.

They apply the Federal Civil Code, the Trade Code and, as far as final consumers are concerned, the Federal Consumer Protection Act. For any dispute, the parties submit themselves to the competent courts of Mexico City, renouncing any other jurisdiction that might be relevant to them.

In the event of a conflict between these terms and a formal contract signed between the parties, the provisions of that formal contract shall prevail only in that which is incompatible with these terms.
